surely a draw is more than justified for each side (and itÂ´s honorful for you to have claimed it), but in my eyes the claim should be your opponnentÂ´s duty: - he is significantly down in time (in your game), - he has refused your earlier offers, - he has lost more than 10% of his games by timeouts...
